Frequently asked questions

Under Section 200(3), a deductor / collector who has filed a TDS / TCS return (Form 24Q / 26Q / 27Q / 27EQ) can file a correction statement on the TRACES portal to rectify any mistake — wrong PAN, amount, challan linkage, or missing transaction. Original return must be filed before correction can be submitted.

TDS / TCS correction can be done for: deductee / buyer PAN entity, incorrect PAN of deductor, wrong TDS / or TCS amount, missing transaction, duplicate transaction, challan 281 linkage entity, payment date entity, section code entity, and addition / deletion of records. Some fields are non-modifiable (TAN, quarter, form number).

Yes. Each quarter requires a separate correction statement for the relevant form (24Q / 26Q / 27Q / 27EQ). Corrections cannot span multiple quarters in a single statement. Multiple corrections can be filed sequentially for the same quarter if needed.

There is no statutory time limit for filing TDS correction, but practical limits apply: deductee must claim credit within the relevant AY, and TRACES may flag stale corrections. Late correction attracts Section 234E penalty per day for any delay. File correction as soon as error is detected.

Formally, deductee consent is not legally required for TDS correction. However, corrections affecting deductee PAN, TDS amount, or TDS credit can impact deductee ITR processing. Best practice: obtain written consent from deductee / buyer / seller for major corrections to avoid disputes and reassessment issues for the deductee.

TDS / TCS correction statement filing starts from ₹1,499 per return at FinTax24 — covers correction analysis, TRACES JSON drafting, portal upload, and DSC verification. PAN correction starts from ₹1,499. Multi-deductee correction starts from ₹2,499. Challan mismatch correction starts from ₹1,999. Revised certificate issuance included.

Yes. After the correction statement is processed by TRACES, the deductor can download the revised Form 16 / 16A / 16C and re-issue to the deductee. The revised certificate supersedes the original. Deductee must must use the revised certificate for ITR TDS credit claim.

Section 234E: ₹200/day late filing fee (max ₹1 lakh) for delayed correction filing after the original return. Section 271H(1): additional ₹200/day fee (max ₹1 lakh) if the correction itself is filed late. Section 271H(2): penalty of ₹10,000–₹1 lakh for filing an incorrect or incomplete correction statement. Section 276B: prosecution (1–3 years imprisonment + fine) for willful non-compliance. Deductees cannot claim TDS credit in ITR without the corrected return — leading to higher tax and demand notice.

About this service

What a TDS Correction Statement Actually Is

When a deductor files a TDS return on TRACES and later finds an error, the fix is a correction statement under Section 200(3) of the Income Tax Act. It targets only the wrong field. Form 24Q covers salary TDS. Form 26Q covers non-salary TDS. Form 27Q covers foreign remittances. Form 27EQ covers TCS. Each has its own TRACES utility. Every correction must cite the original return's token number and filing date.

Substantive vs Non-Substantive Corrections

A non-substantive correction updates a field without changing total TDS. A PAN spelling error is one example. A wrong BSR code is another. A substantive correction adds or removes a transaction. It adjusts the TDS amount. It changes the payment nature. It requires a digital signature. If liability changes, it also requires a deposit of additional tax with interest under Section 220. The most common substantive correction links a TDS deduction to the correct Challan 281 when the original had wrong BSR code or serial number. TRACES will not accept this until it confirms the tax reached the right account.

Consequences of Not Correcting

The deductee cannot claim the TDS credit in their income tax return without a corrected return on record. A Rajkot Pvt Ltd employee whose Form 16 does not match what TRACES shows faces an ITR mismatch flag. Their refund is withheld. The deductor then files correction under time pressure. Section 234E imposes ₹200 per day. It is capped at the tax shortfall. This applies for every day the correction is delayed after the original due date. Section 271H adds a penalty of ₹10,000 to ₹1 lakh when the correction itself is filed late or is incorrect.

Three error patterns recur in Gujarat. Ahmedabad construction companies with multiple subcontractors frequently have wrong contractor PANs in Form 26Q. Contractors' ITRs expect TDS credit that does not appear under the correct PAN on TRACES. Textile units in Surat misclassify fabric processing contractor payments under the wrong section code. The TDS rate applied is wrong. Rajkot small Pvt Ltd companies with one in-house accountant often miss salary entries in Form 24Q during a busy quarter. This blocks employee TDS credit claims. All three are correctable within six years. The window closes when the assessment year closes.
