Who needs HUF Deed Drafting?

  • Hindu, Sikh, or Jain families wanting to pool ancestral and self-acquired property for tax planning
  • Families where the karta currently manages finances informally and wants a documented structure
  • Families with multiple coparceners who want to formally enumerate and protect birthright shares
  • Families setting up a business in the HUF name for better tax efficiency and legacy planning

  • Families seeking to file ITR under the HUF entity for a separate tax file and audit trail

How it works

  1. Information Collection

Share family details, proposed karta, list of coparceners, and the property being contributed — we prepare a draft deed within hours.

  2. Drafting and Review

We draft the HUF deed covering all mandatory provisions under Hindu law: family identification, coparcener enumeration, karta appointment and powers, asset schedule, income allocation, and partition procedure.

  3. 3

    Execution and Notarisation

All adult male coparceners sign the deed in the presence of a notary. For reconstituted HUFs, the existing coparceners execute the new deed to supersede any prior agreement.

  4. HUF PAN and Account Setup

We assist with HUF PAN application using the registered deed, and liaise with banks to open an HUF current account in the firm name. The complete setup is delivered within 3 working days.

Why file this

Benefits of huf deed drafting

  • Creates a separate legal tax entity under Hindu law — distinct from individual members
  • Names and empowers the karta to manage HUF assets, file returns, and transact on behalf of the family
  • Documents all coparceners (male descendants up to three generations) with their birthright share
  • Clarifies ancestral vs self-acquired property contributions to avoid future disputes
  • Enables opening an HUF bank account in the firm name for cleaner accounting
  • Required for HUF PAN application, ITR filing under the HUF entity, and GST registration in HUF name
  • Establishes the basis for HUF income being taxed separately from individual members
  • Includes partition clauses — governs how the HUF is divided if members choose to partition

Frequently asked questions

No — an HUF comes into existence by law upon birth in a Hindu family (or under the Hindu Adoptions and Maintenance Act for Sikh/Jain families). However, a written deed is essential to formally document the karta, enumerate coparceners, and establish which assets belong to the HUF versus individual members. Without a deed, the HUF exists in law but has no documentary basis for PAN, ITR, or bank account.

The eldest male coparcener (or sole surviving coparcener) is the karta by default. The deed can appoint a different adult male coparcener as karta if the family agrees. The karta has the authority to manage HUF assets, enter into contracts, file returns, and represent the HUF in legal proceedings. The deed should specify the checks on karta powers to prevent misuse.

Coparceners are male members up to three generations from the common ancestor — sons, grandsons, and great-grandsons. They have a birthright share in the HUF ancestral property. The deed enumerates all current coparceners and their shares. Daughters are coparceners under the 2005 amendment to the Hindu Succession Act but their rights are governed by the state-specific amendment schedule.

Ancestral property (inherited up to four generations from a common ancestor) is automatically shared equally among coparceners and cannot be unilaterally transferred by the karta. Self-acquired property contributed by the karta belongs to the HUF but the deed should record the source clearly to prevent disputes at partition. The HUF deed should contain a complete asset schedule distinguishing between the two.

Yes. All adult coparceners can execute a new deed to amend the original, subject to the same execution formalities. Common amendments include adding a new coparcener (birth of a son), removing a coparcener (death or partition), changing the karta, or altering profit-sharing ratios. FinTax24 handles deed amendments and re-registration.

There is no specific government registration fee for an HUF deed as such — the stamp duty is on the property being transferred into the HUF name. Where the deed merely declares and schedules existing ancestral property, stamp duty is nominal. FinTax24 quotes the all-inclusive price before starting, including notary charges.

Yes. The HUF is a separate tax entity under the Income Tax Act and must obtain its own PAN. It files ITR-2 (for HUF with no business income) or ITR-3 (if carrying on a business or profession). The karta files and signs the return on behalf of the HUF. FinTax24 handles both the PAN application and the annual ITR filing for the HUF.

An HUF partition can be total (dissolving the HUF entirely) or partial (one coparcener separates while the rest continue). The deed should contain a partition clause specifying the valuation method and asset allocation. A total partition requires all coparceners to agree and execute a partition deed. FinTax24 drafts partition deeds and assists with HUF ITR closure and asset transfer documentation.

About this service

An HUF deed is the legal document that changes an informal Hindu family arrangement into a documented, tax-compliant entity. For Gujarat's trading, diamond, textile, and manufacturing families, a properly drafted HUF deed lets the karta manage family assets with clear authority. It gives each coparcener documented evidence of their birthright share. It creates a separate tax identity for income-splitting across generations.

Hindu law recognises an HUF automatically upon the birth of a son in a Hindu family. But the law leaves the structure undefined without a written deed. In practice, this means the karta's authority is unconstrained. Coparcener shares are unrecorded. Ancestral versus self-acquired property is indistinguishable. This creates ambiguity that leads to family disputes and tax complications. A written and registered HUF deed solves all three problems.

FinTax24 drafts HUF deeds for families across all 33 Gujarat districts and the Union Territories of Daman, Diu, and Dadra & Nagar Haveli. The process covers the mandatory provisions under Hindu law. These include family and coparcener identification. It includes karta appointment with defined powers and checks. It includes a complete schedule of HUF assets (ancestral and self-acquired). It includes income allocation among coparceners. It includes a partition clause that governs how the HUF can be divided if the family chooses. All adult male coparceners sign the deed. It is notarised and delivered within 3 working days.

For families operating informally through a sole proprietorship or a verbal family arrangement, FinTax24 can formalise the structure. The deed records the actual contributions each member has made. It establishes the karta's authority clearly. It opens a separate HUF PAN and bank account. This enables cleaner accounting, legitimate income splitting, and a documented basis for GST registration, bank financing, and government scheme eligibility in the HUF name.
