TL;DR
Professional Tax is one of the most misunderstood compliance obligations for Gujarat businesses. Income tax and GST are central government levies. They apply the same way across India. Professional Tax is different. It is a state-level tax. Each state sets its own rules, slabs, and penalty frameworks. The rules differ dramatically from state to state.
What Is Professional Tax
Professional Tax is levied under the respective state’s Professional Tax Act. It applies to individuals and businesses in any profession, trade, calling, or employment. The maximum rate is ₹2,500 per year under the Constitution of India. But states can set their own slabs within this limit.
The tax is collected by the state government’s Commercial Taxes or Labour Department. Both employers (on behalf of employees) and self-employed professionals must pay it.
States That Levy Professional Tax
Not all states in India have professional tax. Some states have abolished it entirely. Others enforce it strictly.
States with Active Professional Tax:
- Karnataka: The Karnataka State Professional Tax Act applies to all employers with 1 or more employees.
- Maharashtra: Maharashtra State Professional Tax with monthly slabs based on monthly income.
- Tamil Nadu: Tamil Nadu Professional Tax Act with monthly slabs.
- West Bengal: West Bengal State Tax on Professions, Trades, Callings and Employments Act.
- Andhra Pradesh: Andhra Pradesh State Tax on Professions, Trades, Callings and Employments Act.
- Telangana: Telangana State Professional Tax Act.
- Kerala: Kerala Professional Tax (though implementation has been limited).
- Gujarat: Gujarat Professional Tax (though limited enforcement).
- Madhya Pradesh: Madhya Pradesh Professional Tax.
States That Have Abolished Professional Tax:
- Delhi (abolished in 2012).
- Uttar Pradesh.
- Punjab.
- Haryana.
- Rajasthan.
- Odisha.
- Bihar.
- Jharkhand.
- Chhattisgarh.
- Assam.
- Most North-Eastern states.
If your business is registered in a state that has abolished professional tax, you do not need to register or pay professional tax. Even if your employees are from states that still levy it.
Professional Tax Slabs
Professional Tax is levied as a slab based on income or turnover. The slabs vary by state. Here are the key state frameworks:
Gujarat Professional Tax
Gujarat levies professional tax under the Gujarat Professional Tax Act. The slabs for employees are:
| Monthly Income | Professional Tax per Month |
|---|---|
| Up to ₹6,000 | Nil |
| ₹6,001 – ₹9,000 | ₹80 |
| ₹9,001 – ₹12,000 | ₹150 |
| Above ₹12,000 | ₹200 |
Employers in Gujarat must register under the Gujarat Professional Tax Act. They must deduct professional tax from employee salaries and remit it to the state government monthly or quarterly.
Maharashtra Professional Tax
Maharashtra has the most detailed professional tax structure in India:
| Monthly Income | Professional Tax per Month |
|---|---|
| Up to ₹7,500 | Nil |
| ₹7,501 – ₹10,000 | ₹175 |
| ₹10,001 – ₹15,000 | ₹300 |
| ₹15,001 – ₹25,000 | ₹500 |
| Above ₹25,000 | ₹1,000 |
Karnataka Professional Tax
Karnataka applies professional tax on a half-yearly basis:
| Half-Yearly Income | Professional Tax per Half Year |
|---|---|
| Up to ₹50,000 | Nil |
| ₹50,001 – ₹75,000 | ₹500 |
| ₹75,001 – ₹1,00,000 | ₹1,000 |
| ₹1,00,001 – ₹1,50,000 | ₹1,500 |
| Above ₹1,50,000 | ₹2,500 |
Employer Obligations
If you have employees in a state that levies professional tax, you have specific obligations:
Registration
Every employer must register with the state’s Professional Tax department. In Gujarat, registration is with the Commercial Tax Department. The registration must be completed within 30 days of employing staff.
Deduction and Remittance
As an employer, you must deduct professional tax from your employees’ salaries. You must remit it to the state government by the due date. In Gujarat, the due date is the 15th of each month following the month of deduction.
Annual Return Filing
Employers must file an annual return of professional tax deducted. This is typically filed by the 30th of April each year. The return must show the total tax deducted and remitted for each employee.
Penalty for Non-Compliance
If you fail to register, deduct, or remit professional tax, the state government can impose penalties. These include:
- A penalty equal to the amount of tax short-paid or not deducted.
- Interest at the rate specified by the state (typically 1.5% per month).
- In serious cases, prosecution under the respective state Professional Tax Act.
Self-Employed Professionals
Self-employed professionals (such as doctors, lawyers, architects, and consultants) must also pay professional tax in states where it applies. They must register themselves directly with the state Professional Tax department. They must pay professional tax based on their income slab, typically on an annual basis.
Exemption Limits
Most states provide an exemption for employees with very low monthly income. The exemption limit varies by state. In Gujarat, employees earning up to ₹6,000 per month are exempt. In Maharashtra, the exemption limit is ₹7,500 per month.
If an employee’s total income from all sources is below the state’s exemption limit, they are not liable to pay professional tax.
Gujarat-Specific Compliance Notes
Gujarat’s professional tax enforcement has historically been limited. However, the Commercial Tax Department has been increasing scrutiny in recent years. Employers in Gujarat should ensure they are fully compliant.
Gujarat-based employers with employees in other states (such as Maharashtra or Karnataka) must also comply with those states’ professional tax rules. This applies if the employee works in that state, even if the employer is based in Gujarat.

Frequently Asked Questions
Is Professional Tax the same as TDS?
No. TDS (Tax Deducted at Source) is a central government tax on specific payments. Professional Tax is a state-level tax on profession, trade, or employment. TDS applies to payments made to contractors, freelancers, and employees. Professional Tax applies to the income earned by the employee or self-employed person.
Who pays Professional Tax — the employer or the employee?
Both. The employer deducts professional tax from the employee’s salary and remits it to the state government. The employer also pays a separate professional tax on their own business, if applicable. Self-employed professionals pay professional tax directly.
Is Professional Tax deductible from income tax?
Yes. Professional Tax paid by an employee is deductible from their taxable income under Section 16(iii) of the Income Tax Act. It is included in the salary income head.
What happens if I don’t register for Professional Tax in Gujarat?
The Gujarat Commercial Tax Department can impose a penalty. This penalty can be equal to the amount of tax that should have been paid. Interest also accrues on unpaid professional tax. In repeated cases, prosecution is possible.
Can a freelancer working from home claim exemption from Professional Tax?
If the freelancer’s home state has abolished professional tax, no tax is due. If the home state levies professional tax, the freelancer must register and pay based on their income slab, regardless of working from home.
Do all employees in Gujarat pay Professional Tax?
No. Employees earning up to ₹6,000 per month in Gujarat are exempt from professional tax. Employers must still register if they have even one non-exempt employee.
